Terms of Service

1. Agreement

These Terms of Service ("Terms") are a legal agreement between you and GoGufi, S.L. (CIF: B24836421), ("Gufi", "we", "us"), Madrid, Spain. By using gufi.dev and our services (the "Services"), you agree to these Terms and our Privacy Policy. If you represent a company, you confirm you have the authority to bind it.

2. The Services

Gufi is an AI-powered platform that lets you build business software — ERPs, CRMs, dashboards, websites, and automations — using natural language. You describe what you need; Gufi builds it. The service is provided digitally and is available immediately upon registration.

3. Your Account

You must be at least 16 years old to use Gufi. You are responsible for keeping your credentials secure and for all activity under your account. Do not share your login with others.

4. What You Can't Do

Resell, sublicense, or redistribute the Services
Reverse engineer or extract our source code or AI models
Bypass security or access controls
Use bots or scrapers without permission
Upload malicious content or use the Services to harm others
Use AI outputs in high-risk contexts (medical, legal, financial) without your own review
Use the Services to build competing AI products
Violate any applicable law

5. Right of Withdrawal

Under Spanish consumer law (LGDCU Art. 68-79, 101), you have 14 calendar days from the date of purchase to withdraw from any paid subscription without giving a reason. To exercise this right, contact hello@gufi.es before the 14-day period expires. We will refund the full amount within 14 days using the same payment method. Exception: if you have actively used the paid Services (consumed credits or generated content) during the withdrawal period and you consented to begin using the service immediately, you acknowledge that the right of withdrawal may be lost in proportion to the service already provided, as permitted by Art. 102 LGDCU.

6. Billing & Credits

Free and paid plans are available. Paid plans renew automatically — we will notify you by email at least 30 days before each renewal. You can cancel anytime in your account settings before the renewal date. AI features run on credits: free credits expire at the end of their period, paid credits roll over up to your plan limit. All prices shown include applicable taxes. Payments are processed by Stripe. If terminated for breach, remaining credits are forfeited.

7. Your Data

You own everything you create on Gufi — modules, tables, records, views, dashboards, automations, websites, and AI-generated outputs. We do not claim ownership of your data. You grant us a limited license to use your data solely to provide and improve the Services. We do not use your data to train AI models for other customers. Do not upload sensitive data (health records, government IDs, financial account numbers).

8. AI Disclaimer

Gufi uses AI to generate software, code, and configurations. AI outputs may contain errors. You are responsible for reviewing and validating everything the AI creates. Do not rely on AI outputs for critical functions without your own checks. We do not guarantee uniqueness or accuracy.

9. Intellectual Property

We own the platform, software, tools, and technology behind Gufi. You own your data and AI outputs. If you provide feedback or suggestions, we may use them freely.

10. Suspension & Termination

We may suspend or terminate your account if you violate these Terms. You can cancel anytime in your settings. After termination, your data is deleted within 30 days (backups within 90 days).

11. Disclaimers

The Services are provided "as is" and "as available" to the extent permitted by law. This does not affect your statutory rights as a consumer under Spanish law (LGDCU) or EU consumer protection regulations, which are irrenunciable.

12. Limitation of Liability

Our total liability is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect, incidental, or consequential damages. This limitation does not apply where liability cannot be excluded under Spanish or EU law, including in cases of gross negligence or willful misconduct.

13. Governing Law

These Terms are governed by the laws of Spain. Disputes shall be submitted to the courts of Madrid, without prejudice to mandatory consumer protection provisions in your jurisdiction. You may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

14. Public Sites

Websites published through Gufi ("Public Sites") are the sole responsibility of the user who creates and publishes them. The user is responsible for complying with all applicable regulations, including but not limited to the GDPR (General Data Protection Regulation), LSSI-CE, cookie policies, legal notices, and any other local or international data protection laws. Gufi acts as a data processor and does not assume responsibility for the content, legal compliance, or data processing practices of Public Sites. Gufi may offer tools to help users meet their legal obligations, but their use and correct implementation remains the user's responsibility.

Third-Party Integrations

Gufi allows you to connect third-party services (Google/Gmail, Stripe, Redsys, etc.) to your workspace via OAuth or API keys. By connecting an account:

You authorize Gufi to act on your behalf within the scope you explicitly granted.
You remain responsible for compliance with the third-party's own terms of service.
For Google services, our use of your data is governed by the Google API Services User Data Policy, including the Limited Use requirements. See our Privacy Policy for full details on what Google data we access and how we store it.
You can revoke access at any time, either from within Gufi (Disconnect button) or directly from the third-party's settings (e.g. myaccount.google.com/permissions for Google).

Limited Use of Google User Data

Gufi's use and transfer of information received from Google APIs adhere to the Google API Services User Data Policy, including the Limited Use requirements. We specifically:

Use Google user data only to provide or improve user-facing features that are prominent in our Gufi product (sending transactional emails on the user's behalf).
Do NOT transfer Google user data to others, except as necessary to provide or improve user-facing features, or to comply with applicable law.
Do NOT use Google user data for advertising purposes.
Do NOT allow humans to read Google user data, except with explicit user consent, for debugging, when required by law, or when the data has been aggregated and anonymized.

Lead Generation (B2B)

The "Search leads with AI" feature collects professional B2B contact data that the companies themselves have published publicly (industry directories, associations, corporate sites). You act as the Data Controller; Gufi is the Data Processor for the tool. Before first use you must accept the in-app DPA. By using this feature you commit to:

Not use the data for B2C spam or any purpose other than legitimate B2B outreach.
Include a clear, functional opt-out in every outreach (email, call, SMS).
Not resell or transfer the data to third parties without your own legal basis.
Honour suppression requests received via /baja-datos; Gufi automatically filters suppressed records before returning them.
Comply with GDPR and the local rules governing your commercial activity.

15. Changes

We may update these Terms. Material changes will be notified 30 days in advance by email. If you disagree, you may cancel your account before the changes take effect. Continued use after the effective date constitutes acceptance. Current version always at gufi.dev/terms.
